Terms & Conditions (T&C)

1. Scope

These Terms & Conditions apply to all orders placed via the online shop of Mozer ArtWorks, as well as to individual inquiries and commissions handled outside the shop.

Any deviating terms and conditions of the customer shall not be recognized unless their validity is expressly agreed to in writing.

3. Offer and Conclusion of Contract

3.1 Online Shop

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the button “Buy”, the customer submits a binding offer to enter into a contract.

After placing an order, the customer receives an automated order confirmation. This does not yet constitute acceptance of the offer.
The contract is only concluded when:

  • an explicit order confirmation is sent by email, or

  • the goods are dispatched.

3.2 Orders Upon Request

For individual inquiries (e.g. original artworks, commissioned works, prints, photographs, merchandise or special requests), the customer receives a binding offer.
The contract is concluded as soon as the customer accepts this offer in writing.


4. Prices and Small Business Regulation

Mozer ArtWorks operates as a small business in accordance with Section 19 of the German VAT Act (UStG).
Therefore, no VAT is shown.

All prices are final prices plus shipping costs.


5. Payment Methods

The payment methods offered in the online shop are displayed to the customer during the order process.
Regardless of this, payment by advance payment / bank transfer is always possible.

Payment is due immediately upon conclusion of the contract unless otherwise stated during checkout.
If the goods are collected in person, cash payment is also possible.


6. Delivery, Shipping and Collection

6.1 Delivery Areas

Delivery of Artworks

Artworks (including original artworks, limited editions and high-quality fine art prints) are delivered to the following countries:

Belgium, Bulgaria, Denmark, Estonia, Finland, France, Germany, Greece, Ireland, Italy, Croatia, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Norway, Poland, Portugal, Romania, Sweden, Switzerland, Slovakia, Slovenia, Spain, Czech Republic, Hungary, United Kingdom, Cyprus, and Austria.

Customs and Import Information

For deliveries to countries outside the European Union (in particular Norway, Switzerland, Liechtenstein and the United Kingdom), additional customs duties, taxes or fees may apply, which must be borne by the customer.
These costs are not included in the purchase price or shipping costs and may vary depending on the destination country.

The customer is responsible for complying with all applicable import regulations in their country.

If delivery is not possible due to country-specific import restrictions, the customer will be informed immediately and any payments already made will be refunded.

Print-on-Demand Products

Print-on-demand products (e.g. textiles, posters and merchandise) may be delivered to additional countries.
The available delivery countries for print-on-demand products are shown to the customer during checkout or on the respective product page.

For such deliveries, country-specific customs duties and import charges may also apply and must be borne by the customer.


6.2 Shipping Service Providers & Insurance

Shipping is carried out via suitable shipping service providers (e.g. DHL, UPS or comparable services).
All shipments are sent insured.


6.3 Shipping Costs

The applicable shipping costs are displayed during the order process or stated in the offer document.


6.4 Collection

Collection in Stuttgart is only possible by prior appointment.

Upon collection, the customer must present an order confirmation or proof of identity.

Upon handover of the goods to the customer, the risk of accidental loss or accidental deterioration of the goods passes to the customer.


7. Print-on-Demand Products

Some products (e.g. prints, textiles, merchandise) are produced via an external print-on-demand service provider and shipped directly.

7.1 Production Notes

Production begins only after the order has been received.
Minor deviations in colour, material, or dimensions that may occur due to production processes do not constitute a defect.

7.2 Right of Withdrawal for Print-on-Demand

There is no right of withdrawal for personalised or customer-specified print-on-demand products.

For non-personalised print-on-demand products, the statutory right of withdrawal applies.
Any deviations or special conditions will be stated separately during checkout.

7.3 Delivery Times

Due to individual production, longer delivery times may occur.


8. Retention of Title

Retention of Title and Usage Rights

(a) Until full payment has been received, the delivered goods—physical as well as digital—remain the property of Mozer ArtWorks.
(b) Upon full payment, ownership of physical artworks transfers to the customer.
(c) For digital content, print files or reproductions, only a non-exclusive, personal right of use is granted. Any further use, in particular reproduction, publication or commercial use, requires the prior written consent of the rights holder.
(d) The customer is obligated to protect digital content from unauthorised access by third parties.


9. Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days.

9.1 Exclusion / Expiry of the Right of Withdrawal

The right of withdrawal is excluded in particular for:

  • personalised or specially produced clothing, prints or other custom-made products

  • individually created commissioned artworks

9.2 Return Shipping Costs

The customer bears the direct costs and any insurance fees for returning the goods.

Any loss of value caused by handling beyond what is necessary to assess the goods must be compensated by the customer.


10. Warranty

The statutory warranty rights apply.

Individual variations in original artworks (e.g. texture, colour nuances, the artist’s handwriting/style) are inherent to the work and do not constitute a defect.


11. Certificate of Authenticity for Original Artworks

When purchasing an original artwork, the customer receives a numbered certificate of authenticity signed by the artist.
The certificate is part of the artwork.


12. Copyright and Intellectual Property

All works (paintings, graphics, prints, photographs, designs, motifs) as well as all content of Mozer ArtWorks are subject to the copyright of Ramon Mozer or the respective artist.

The purchase of a work does not include any rights of use for reproduction, publication or commercial exploitation.
Any use beyond private purposes requires prior written consent.


13. Discount and Promotional Offers

Limited-time discount or special promotions (e.g. shop opening, seasonal discounts) are voluntary offers and may be changed or ended at any time.

For orders already placed, the price displayed at the time of ordering applies.

16. Dispute Resolution

(a) Mozer ArtWorks voluntarily participates in the EU Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
(b) Consumers may use this platform.
(c) For merchants and legal entities under public law, Stuttgart shall remain the exclusive place of jurisdiction.
(d) This provision does not affect mandatory consumer protection rights of customers within the EU.


17. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers outside Germany, mandatory consumer protection provisions of their country of residence remain unaffected.

If the customer is a merchant or a legal entity under public law, Stuttgart shall be the exclusive place of jurisdiction.

Right of Withdrawal

Withdrawal Policy

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party designated by you (who is not the carrier) has taken possession of the goods.

To exercise your right of withdrawal, you must inform us:

by means of a clear statement (e.g. by letter or email) of your decision to withdraw from this contract.


Consequences of Withdrawal

If you withdraw from this contract, we will reimburse you all payments received from you, including delivery costs (except for additional costs resulting from choosing a special type of delivery).
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You shall bear the direct cost of returning the goods as well as the cost of shipping insurance.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

LIABILITY

Unlimited liability: for damages resulting from intent, gross negligence, or personal injury (injury to life, body or health).

Simple negligence: only for damages arising from the breach of essential contractual obligations (cardinal duties), limited to the typical and foreseeable damage.

Excluded: loss of profit, indirect damages or consequential damages, insofar as legally permissible.
